1. Who we are

The store is operated by Dermeva Beauty Group Inc., a Delaware corporation, with its registered place of business at 132 Christiana Mall, Newark, DE 19702, United States. References to "Dermeva", "we", "us" and "our" mean Dermeva Beauty Group Inc.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By ordering you confirm that you are old enough and that the information you provide is accurate and complete.

3. Products and descriptions

We take care to describe our products accurately. Photographs are illustrative; minor variations in shade, packaging, or batch number may occur. Cosmetic products are intended for external use only and are sold subject to the disclaimers in our Disclaimer & Acceptable Use page. Always read the on-pack ingredient list and patch-test before first use.

4. Orders, prices and payment

• Prices are shown in your local currency where supported and include VAT in the United Kingdom. Sales tax, GST/HST/PST and import duties may apply at checkout or on delivery depending on your destination.
• Your order is an offer to buy. A binding contract is formed only when we send a dispatch confirmation. Until then we may decline or cancel an order — for example, if a product is out of stock, a price was incorrectly stated, or we suspect fraud — and will refund any payment taken.
• We accept Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay and Shop Pay. All payments are processed by PCI-DSS compliant providers; we do not store full card numbers.

5. Delivery

We ship to the United States, the United Kingdom, and Canada. Shipping costs, transit times, customs charges, and risk of loss are described in our Shipping Policy.

6. Returns, refunds and consumer rights

Our 90-day money-back guarantee, the conditions under which products may be returned, and the refund timing are set out in our Return Policy.

• UK customers additionally have a 14-day statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and statutory rights under the Consumer Rights Act 2015 that products be of satisfactory quality, fit for purpose, and as described. Nothing in these Terms limits those rights.
• Canadian customers retain all rights under applicable provincial consumer-protection legislation.
• US customers retain all rights under federal and state consumer-protection law.

7. Intellectual property

All content on the store — including text, graphics, photography, product names, the Dermeva and CollagenicBoost™ marks, and the underlying code — is owned by or licensed to Dermeva Beauty Group Inc. and is protected by copyright, trademark and other intellectual property laws. You may view and print pages for personal, non-commercial use. Any other use, including reproduction, modification, distribution, scraping, or the use of automated systems to extract data, requires our prior written permission.

8. User content

If you submit a review, photo, or other content to the store you grant Dermeva a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, display and distribute that content in connection with the store and our marketing, with attribution where reasonable. You confirm that the content is yours to share and does not infringe anyone else's rights.

9. Acceptable use

You agree not to: misuse the store; introduce malware or attempt to gain unauthorised access; reverse-engineer or copy our software; submit false or misleading information; harass our staff or other users; or use the store for any unlawful purpose. We may suspend or terminate access for material breach.

10. Disclaimers

The store is provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Statements about skin benefits are based on user-reported experience and ingredient research; results vary, and our products are cosmetic — they are not intended to diagnose, treat, cure or prevent any medical condition.

11. Limitation of liability

To the fullest extent permitted by law, Dermeva will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, goodwill, data, or business opportunity, arising from or in connection with the store or our products. Our total aggregate liability to you for any claim is limited to the greater of (a) the amount you paid for the product giving rise to the claim and (b) one hundred US dollars (US $100).

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products under applicable product-liability law, or — for UK customers — the statutory rights described in section 6.

12. Indemnity

You agree to indemnify Dermeva and its affiliates against any third-party claim arising from your breach of these Terms, your misuse of the store, or your infringement of any law or third-party right.

13. Governing law and disputes

These Terms and any dispute arising from them are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and the state and federal courts located in New Castle County, Delaware will have exclusive jurisdiction — except that:

• If you are a consumer resident in the United Kingdom, the European Economic Area, or Canada, you also benefit from the mandatory consumer-protection laws of your country or province, and you may bring proceedings in the courts of your home jurisdiction.
• UK consumers may use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date will change. Material changes affecting your rights will be highlighted on the store and, where appropriate, communicated by email.

15. General

If any provision of these Terms is held unenforceable, the remainder will continue in full effect. Our failure to enforce a right is not a waiver of it. These Terms (together with the Privacy Policy, Cookie Policy, Shipping Policy, Return Policy, and Disclaimer) form the complete agreement between you and us in relation to the store.
